Why would you have a Christmas tree up in August?

Shots were fired on Pierce Avenue this week and police recovered an AK-47 beneath a Christmas tree in the apartment of a man charged with menacing. Witnesses told police several shots were fired, but no one was injured. A man on the porch of a 22nd Street home, who was described as being intoxicated, tried to entice them to fight and then fired the shots before running into his apartment in the 1300 block of 22nd, they told police.

In addition to the assault rifle, police also confiscated 12 long guns, three pellet guns, a crossbow, a compound bow and a baton. Police charged Jacob N. Shimmel, 28, with second-degree menacing. A frightened woman and two children were also living in the apartment, according to police.

More shots fired

A resident on the 500 block of 19th Street reported to Falls police that about 6:30 a.m. Sunday someone fired three shots at their home. A responding officer found three rounds at the home — one in a window frame in the front of the house, fragments of a round were on the front porch and a third round was found in the home in some clothing.

As so often happens in these cases, the resident said he didn’t see who fired the shots and had no idea who might want to kill him.

Drunk driving in Lockport

Dante V. Kinney, 19, of Lockport, was charged with driving while intoxicated, having an alcoholic beverage in the vehicle, unlawful possession of marijuana, failure to signal a turn and an equipment violation. Kinney was pulled over for driving with a flat tire. When speaking with Kinney, an officer determined he was drunk and took him into custody without incident.

More drunk driving in Lockport

James F. Brice, 41, of Tonawanda, was charged Friday with DWI and unlicensed operation of a motor vehicle. After being stopped for a traffic violation in the Town of Lockport, Brice appeared intoxicated and failed a series of field sobriety tests. Deputies determined that Brice’s license was revoked due to a previous DWI charge. He was held on $750 and is due in court Sept. 6.

Drunk driving in Niagara Falls

Kevin King, 31, of Niagara Falls, was charged with DWI and unlawful possession of marijuana, according to New York State Police. Troopers stopped King on the I-190 in the city for swerving back and forth while driving 80 mph in a 65 mph zone. King appeared intoxicated and was taken into custody following field sobriety tests. A breath test revealed his blood alcohol content to be 0.14 percent, the report said. Troopers said King was also found to be in possession of about 16 grams of marihuana.

Never hit a woman

Police are investigating a report of a woman being struck in the face by a man whom she had been arguing with while walking in the 1300 block of South Avenue late Tuesday. Police reports indicated that the woman was walking with the male suspect when the pair started arguing and the man “struck her in the face with an open hand, causing her to bite her lip. Reports said when the victim told the suspect she was going to call the police, he fled the scene on foot. The victim had a small amount of blood in her mouth and was evaluated by Rural Metro but refused to go to the hospital for treatment.

Out of order!

Maurice Manual Ubiles, 30, of 1870 Michigan Ave., was arrested and charged with disorderly conduct after he came outside of a residence on Linwood Avenue and started yelling at neighbors and people walking by. When an officer shined a light on Ubiles to see who was yelling, reports indicated that Ubiles yelled at the officer: “Why you put that light all in my face?” Reports said Ubiles then started walking toward the officer in an “aggressive manner” and stated: “Why you put that (expletive) light in my face?”

To repeat Ubiles was arrested and charged with disorderly conduct.
